NAIROBI, Kenya<\/strong> \u2014 The High Court in Nairobi has temporarily barred the Kenyan government from establishing or operating Ebola quarantine, isolation, or treatment facilities in the country under any arrangement involving the United States government or any foreign agency.<\/p>\r\n\r\n\r\n\r\n

In conservatory orders issued on May 28, 2026, Lady Justice Patricia M. Nyaundi ruled that the government should halt any plans linked to the disputed arrangement pending the hearing and determination of a petition filed before the court.<\/p>\r\n\r\n\r\n\r\n

The case, filed at the Milimani High Court was brought by the Katiba Institute against the State Law Office.<\/p>\r\n\r\n\r\n\r\n

Ebola-Exposed Persons<\/strong><\/p>\r\n\r\n\r\n\r\n

The court further restrained the government, its agents, and any persons acting under its authority from admitting into Kenya, transferring, receiving, or facilitating the entry of persons exposed to or infected with the Ebola virus under the alleged arrangement.<\/p>\r\n\r\n\r\n\r\n

Justice Nyaundi stated that the court was persuaded that the matter raised issues of public interest warranting interim conservatory orders.<\/p>\r\n\r\n\r\n\r\n

\u201cA conservatory order is hereby issued restraining the Respondents from establishing, operationalising, facilitating, approving or permitting the establishment and\/or operation of any Ebola exposure, quarantine, isolation or treatment facility in Kenya,\u201d part of the court order reads.<\/p>\r\n\r\n\r\n\r\n

The judge clarified that the orders would remain in force pending an inter-partes hearing of the application.<\/p>\r\n\r\n\r\n\r\n

Certificate of Urgency<\/strong><\/p>\r\n\r\n\r\n\r\n

Court documents show that Katiba Institute filed the petition under a certificate of urgency alongside a Notice of Motion dated May 28, 2026.<\/p>\r\n\r\n\r\n\r\n

The court directed the petitioners to serve the respondents within 24 hours, while the State Law Office and other respondents were ordered to file their responses within 48 hours after service.<\/p>\r\n\r\n\r\n\r\n

The matter is scheduled for mention on June 2, 2026, for further directions.<\/p>\r\n\r\n\r\n\r\n
